The Brazilian Institute of Geography and Statistics (IBGE) informs that it will promptly comply with the recent decision of the Federal Court of Accounts (TCU) regarding the IBGE+ Foundation and that it has already begun studies for new alternatives to ensure the modernization of its structures and the advancement of data production and geosciences in the country.
The IBGE reaffirms its conviction in the legality and strategic necessity of a Technological Innovation Center (NIT) with efficient management, in accordance with the Legal Framework for Science, Technology and Innovation. The creation of IBGE+ was the result of a rigorous process, based on:
- Legal obligation to structure your NIT as a public Scientific and Technological Institution (ICT);
- Precedent from the TCU itself (Appellate Decision 1,832/2022), which encouraged the creation of NITs with their own legal personality;
- Jurisprudence of the Supreme Federal Court (STF) (ADI 4863), which validated models of public foundations under private law;
- Endorsement from the Federal Public Prosecutor's Office (MPF), filing cases about the legality of the model.
The Institute acted with complete diligence and transparency, searching the legal framework that would best allow Brazil to advance at the forefront of knowledge, without relinquishing public oversight.
The TCU's decision, while respected, represents a challenge to the agility that the Brazilian innovation ecosystem needs. However, IBGE's commitment to innovation is unwavering.
In accordance with institutional procedures, the Notice for the Joint Meeting of the IBGE Board of Directors and the Board of Trustees of the IBGE Foundation for Support of Scientific and Technological Innovation was published.
The Institute will continue to engage in dialogue with institutions and work to find ways for Brazil to compete on an equal footing in the global technological race, always in strict compliance with the law and the public interest.
